The agreement

By texting the stimulus phone number, opting in to the service, or paying for a subscription, you agree to these terms and to the privacy policy. If you do not agree, do not use the service.

These terms are between you and Mark Calip, operator of stimulus ("we," "us," "stimulus").

The service

stimulus is an AI-assisted strength-training coach delivered over SMS. There is no app to install. After opt-in and onboarding, you receive coaching messages tied to your training schedule and may submit workouts and questions by text.

SMS terms

You opt in by texting the stimulus phone number from your own device. After opt-in you will receive recurring coaching messages, typically once on training mornings and once after each workout you submit, plus a weekly observation and replies to your messages. Message frequency varies based on how often you train and message us.

Reply STOP to opt out. You will receive one final confirmation message and no further messages from the service. Reply HELP for help. Standard message and data rates may apply, depending on your carrier plan.

We do not share your phone number, opt-in data, or consent information with third parties for marketing or promotional purposes. See the privacy policy for full detail.

Your account and conduct

You must be at least 16 years old to use stimulus. You are responsible for the phone number you opt in with and for the content of messages you send. You agree not to:

• Use the service to harass, threaten, or harm anyone.
• Submit content that is unlawful, fraudulent, or violates someone else's rights.
• Attempt to probe, scan, or test the vulnerability of the service, or to bypass authentication or rate limits.
• Use the service to send spam or unsolicited content back to us.
• Resell, sublicense, or commercially exploit the service without our written consent.

Subscription, billing, and cancellation

stimulus offers a free trial period (currently 45 days) followed by a paid subscription (currently $4.99 per month). Pricing in effect at the time you subscribe applies; we will give notice before any change.

Payments are processed by Stripe. The subscription renews monthly until you cancel. You can cancel at any time by texting CANCEL to the stimulus number or by emailing support@stimulus.com. Cancellation takes effect at the end of the current billing period; we do not prorate partial months.

We may offer refunds at our discretion for genuine billing errors or service failures. Contact support to request one.

Health and training disclaimer

stimulus is a coaching tool, not a medical service. Coaching messages are general fitness guidance and are not medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before starting any new training program, especially if you have a medical condition, are pregnant, or are recovering from an injury.

You assume full responsibility for any training you perform based on messages from the service. If something hurts in a way that does not feel like normal training fatigue, stop and seek appropriate care.

AI-generated content

Coaching messages are generated by AI models acting on your training data. AI output can occasionally be incorrect, inconsistent, or inappropriate for your specific situation. Use judgment, and contact support if a recommendation seems wrong.

Intellectual property

The stimulus name, brand, software, prompts, and underlying systems are owned by us. Coaching messages we generate for you are licensed to you for personal, non-commercial use during your subscription. Workout data you submit remains yours; you grant us a limited license to process it solely to deliver the service.

Termination

You can stop using stimulus at any time by texting STOP (to end SMS) or CANCEL (to end your subscription). We may suspend or terminate your access if you violate these terms, abuse the service, or for legal or safety reasons. We will refund any unused prepaid time on a pro rata basis if we terminate without cause.

Warranty disclaimer

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will be accurate.

Limitation of liability

To the fullest extent permitted by law, stimulus and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the service. Our total cumulative liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars.

Changes to these terms

We may update these terms from time to time. The effective date at the top reflects the most recent update. Material changes will be communicated to active users via SMS before they take effect. Continued use after the effective date constitutes acceptance.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you and we consent to personal jurisdiction there.
